Le Mikado – Terms and Conditions of Sale

1. Introduction and Agreement
1.1 Parties to the Agreement

These Terms and Conditions (“Terms”) govern your use of the Le Mikado website, located at www.lemikado.com (the “Website”), and all purchases of goods and services (the “Products”) from Le Mikado (“we,” “us,” or “our”).

1.2 Acceptance of Terms

By accessing, browsing, or using the Website, or by placing an Order with us, whether online or via telephone, you acknowledge that you have read, understood, and agree to be legally bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you must not use the Website or place an Order.

1.3 Changes to Terms

We reserve the right to modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting on the Website. Your continued use of the Website and services following any such changes constitutes your acceptance of the new Terms. The Terms applying to your Order will be those in force at the time you place the Order.


2. Orders and Product Substitution
2.1 Order Placement and Acceptance

All Orders placed through the Website are subject to our acceptance. Order confirmation, which is generated automatically and sent to you via email, does not signify final acceptance. We reserve the right to accept, refuse, or limit your Order for any reason, including product availability, errors in pricing or product description, or suspicion of fraudulent activity (see Section 7).

2.2 Product Appearance and Substitution Policy

Fresh flowers are natural, perishable products, and all images on the Website are for illustrative purposes. Due to seasonal availability, market conditions, and the unique nature of floristry, we reserve the right to substitute any specific flower, plant, or accessory with an item of equal or greater value, quality, and similar style. We will make every effort to maintain the overall look and color scheme of the selected arrangement. If the substitution is significant, we will attempt to contact you via email or phone prior to dispatch.


3. Pricing and Payment
3.1 Pricing

All prices are displayed in USD. Prices are subject to change without notice, but the price charged for an Order will be the price in effect at the time the Order is placed.

3.2 Payment

We accept payment via Visa, MasterCard. Full payment is required before any Order is dispatched. By submitting an Order, you confirm that the payment details provided are valid and correct and that you are authorized to use the chosen payment method.


4. Order Modifications, Cancellations, and Refunds
4.1 Order Changes (Delivery Address, Message, etc.)

We will always do our best to accommodate last-minute changes. However, we can only guarantee changes (including to the delivery address or card message) requested at least 24 hours prior to the scheduled dispatch time.

4.2 Order Cancellation

Orders may be cancelled up to 48 hours prior to the intended Delivery Date for a full refund.

4.3 Non-Refundable Cancellations

Requests for Order Cancellation on the same day as the Delivery Date are NOT refundable, as the arrangements are often already prepared or dispatched for delivery.

4.4 Quality and Refunds

If you are not satisfied with the quality of the Products delivered, you must notify us within 24 hours of receipt by contacting CustomerCare@lemikado.com. Due to the perishable nature of flowers, a photograph of the arrangement is required to process a refund or replacement request. We reserve the right to offer a full refund, a partial refund, or a replacement at our discretion.


5. Delivery
5.1 Delivery Information Accuracy

It is the Customer’s responsibility to ensure that the recipient’s address, contact number, and any necessary delivery instructions are complete and accurate. We cannot be held responsible for non-delivery or late delivery resulting from incorrect or incomplete information provided by you.

5.2 Recipient Availability

If the recipient is unavailable at the time of delivery, our driver will attempt to:

  1. Leave the Products with a neighbor or a secure reception/concierge (if applicable).

  2. Leave a delivery notification card or contact the recipient. If we deem the location unsafe or cannot contact the recipient, the driver may return the arrangement to the shop, and a redelivery fee may apply.

5.3 Deliveries to Hospitals and Secured Locations

Deliveries to hospitals, businesses, hotels, and military bases are delivered to a reception, mailroom, or security desk as per the location’s policy. We cannot guarantee delivery directly to the recipient/patient or a specific ward.

Crucially, it is your responsibility to confirm that the location (e.g., hospital ward) is willing and able to accept flower/gift deliveries. If the location refuses the delivery or the recipient has been discharged, and we cannot complete the delivery, we will not be able to refund the cost of the Products.

5.4 Risk

The risk of loss or damage to the Products passes to you upon delivery to the confirmed address or secure drop-off point (e.g., concierge or neighbor).


6. Limitation of Liability

To the fullest extent permitted by law, Le Mikado shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, or data, resulting from the use or inability to use the Products or services. Our total liability to you in respect of any Order will not exceed the total price paid for the Products in that specific Order.


7. Fraudulent Activity and Indemnity
7.1 Fraudulent Behaviour

If we suspect an Order to be fraudulent in nature, we reserve the right to cancel the Order and refund the funds immediately. We are under no obligation to disclose the reasons for our suspicion. We will cooperate fully with law enforcement in investigations of fraudulent or criminal activity.

7.2 Indemnity

You agree to indemnify, defend, and hold harmless Le Mikado and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, and costs (including reasonable legal fees) arising from your use of the Website, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.


8. Intellectual Property

All content on this Website, including text, graphics, logos, images, and product designs, is the property of Le Mikado or its content suppliers and is protected by intellectual property laws. You may not use, reproduce, modify, or distribute any content without our prior written permission.


9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of the laws of Lebanon. Any dispute arising out of or relating to these Terms or your use of the Website shall be subject to the exclusive jurisdiction of the courts of Beirut.
